For Law Enforcement Valid Legal Process Member Privacy
Overview

Who this page is for.

This page is for law enforcement officers, government agencies, and other officials seeking records or information from RMO through valid legal process. RMO is committed both to protecting the privacy of its members and to complying with valid legal process issued in accordance with applicable law.

RMO reviews and responds to legal process that is valid, properly issued, and properly served. RMO produces records only to the extent required and permitted by applicable law, and reserves the right to object to or seek to narrow requests that are overbroad, unclear, or not properly issued.

This page is not for members. If you are an RMO member with an account question, a fraud or identity-theft concern, or a support need, please contact RMO Member Services — not the channels described here. Member fraud reports are handled through the Security Center.

Types of Legal Process

What RMO accepts.

Different types of legal process can compel different categories of records. The descriptions below are general; the specific records RMO can provide depend on the legal process presented and on applicable law.

RMO takes reasonable steps to validate the authenticity of legal process and the identity of the requesting official before disclosing any information.

How to Submit

Submitting a request.

To help RMO locate the correct records and respond accurately and promptly, every request should include:

Where to send it. RMO is building a dedicated, secure Law Enforcement Request Portal so agencies can submit legal process and track requests online. Until the portal is available, valid legal process should be directed to RMO’s Legal department through the channel RMO designates for service of process. To confirm the current address for service, or to reach the RMO Legal & Compliance team, contact RMO and ask to be routed to Legal.

Emergency & Preservation

Emergency requests and preservation.

Emergency requests. In situations involving an imminent threat of death or serious physical harm to a person, RMO may voluntarily provide information to law enforcement to the extent permitted by applicable law. An emergency request should be clearly marked as an emergency, come from a law enforcement official, and describe the nature of the emergency, the specific danger involved, and how the requested information will help address it. RMO reviews each emergency request and responds as quickly as the circumstances reasonably allow.

Preservation requests. Law enforcement may ask RMO to preserve records pending the issuance of formal legal process. On receipt of a valid preservation request, RMO will preserve the available records it can identify for the period provided by applicable law. A preservation request does not itself compel disclosure — appropriate legal process is still required for RMO to produce the preserved records.

Notice, Costs & Contact

What else to know.

Notice to members. Consistent with applicable law and RMO’s commitment to transparency, RMO will make reasonable efforts to notify a member when their records are sought through legal process, unless RMO is prohibited from giving notice — for example, by a court-ordered non-disclosure provision — or unless notice is otherwise prohibited or inappropriate, such as in an emergency.

Cost reimbursement. RMO may seek reimbursement for the reasonable costs of searching for, retrieving, and producing records in response to legal process, to the extent permitted by applicable law.

No waiver. Responding to a request, or describing a process on this page, does not waive any objection RMO may raise, and RMO reserves all rights. This page is provided for general informational purposes and is not legal advice.
